When you visit our website www.speakinggarments.com, the browser used on your device automatically sends information to our website server. This information is temporarily stored in a so-called log file. This data includes, for example, browser type and version, operating system used, referrer URL (previously visited page), IP address of the requesting computer, server request date and time of access, and client file request (file name and URL).

This data is processed in order to ensure a smooth connection to the website, to ensure the comfortable use of our website, to evaluate the security and stability of the system and for other administrative purposes. 

The legal basis for data processing is Art. 6 para. 1 p. 1 lit. f of GDPR. Our legitimate interest follows from the data collection purposes listed above. Under no circumstances do we use the collected data to draw conclusions about your person.

2. Cookies

We use cookies on our site. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not harm your device, do not contain viruses, trojans or other malicious software.

In the cookie information is stored, each resulting in connection with the specific end device used. However, this does not mean that we are immediately aware of your identity.

On the one hand, the use of cookies serves to make the use of our service more pleasant for you. For example, we use so-called session cookies to recognize that you have already visited individual pages on our website. These are automatically deleted after leaving our site.

3. Google Analytics

For the purpose of customizing and continually optimizing our pages, we use Google Analytics, a web analytics service provided by Google Inc. (https://www.google.com/intl/en/about/) (1600 Amphitheater Parkway, Mountain View, CA 94043, USA, hereafter "Google"). In this context, pseudonymized usage profiles are created and cookies (see under point 2) are used. The information generated by the cookie about your use of this website, such as browser type / version, operating system used, referrer URL (the previously visited page), host name of the accessing computer (IP address), time of server request are sent to a server of Google transferred to the US and stored there. The information is used to evaluate the use of the website, to compile reports on website activity and to provide other services related to the use of the website and internet for the purpose of market research and the needs-based design of this website. This information may also be transferred to third parties if required by law or if third parties process this data on our behalf. Under no circumstances will your IP address be merged with any other data provided by Google. The IP addresses are anonymized, so that an assignment is not possible.

This processing is based on Art. 6 para. 1 sentence 1 lit. f GDPR. With the tracking measures to be used, we want to ensure a needs-based design and the continuous optimization of our website. On the other hand, we use the tracking measures to statistically record the use of our website and evaluate it for the purpose of optimizing our service for you. These interests are to be regarded as justified within the meaning of the aforementioned provision.

4. Facebook Custom Audience on the pixel method

This website uses the "Facebook Pixel" of Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA (“Facebook”). In the case of explicit consent, this may track the behavior of users after they have seen or clicked on a Facebook ad. This process is designed to evaluate the effectiveness of Facebook advertisements for statistical and market research purposes and may help to optimize future advertising efforts.

The data collected is anonymous to us and does not provide us with any conclusions about the identity of the users. However, the data is stored and processed by Facebook, so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes, according to the Facebook data usage policy (https://www.facebook.com/about/privacy/). You can enable Facebook and its affiliates to display ads within and outside of Facebook. For these purposes, it can store a cookie on your computer. These processing operations are carried out exclusively upon granting the express consent in accordance with Art. 6 para. 1a of the GDPR.

Consent in the use of the Facebook pixel may only be declared by users who are older than 13 years old. If you are younger, we request that you ask your guardians for permission.
Based in the US, Facebook Inc. is certified to the US Privacy Shield, which ensures compliance with the level of data protection in the EU.

We maintain online presence within social networks and platforms in order to communicate with customers, prospects and users active there and to inform them about our services. When connecting to respective networks and platforms, the terms and conditions and the data processing guidelines apply to their respective operators. Unless otherwise stated in our Data Privacy Statement, we process user data as long as they communicate with us within social networks and platforms, e.g. write posts on our social media pages or send us messages.

Processing of orders and payment transactions

For the processing of your orders and the payment transactions, we process your email address, your home address, your delivery address and, depending on the payment method, your credit card or PayPal data. If there are problems with the delivery of your items, we may also use your phone number to contact you with any queries.

Processing is based on Art. 6 para. 1 lit. b (execution of order transactions) and c (legally required archiving) of GDPR. 

We disclose the data to third parties only in the context of delivery, for example, to suppliers and freight forwarders, for payment or within the scope of the legal permissions and obligations to legal advisors and authorities. This processing is based on Art. 6 para. 1 lit. b (execution of orders) of GDPR. The data will only be processed in third countries if this is necessary for the fulfillment of the contract (for example on customer's request upon delivery or payment).

To process payments via credit card or PayPal, we pass on your payment data (for example, first name, name, e-mail address, purchase price) to the authorized credit card company, e.g. PayPal or other payment service providers. This submission is necessary to process your order using your selected payment method, in particular to confirm your identity, to administer your payment and the customer relationship. This processing is based on Art. 6 para. 1 lit. b (execution of orders) of GDPR.

If you decide in the context of your order process to make payment via the online payment service PayPal, your contact details will be sent to PayPal as part of the triggered order. PayPal is a service provided by PayPal (Europe) S.à.r.l. & Cie. S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. PayPal assumes the role of an online payment service provider as well as a trustee and offers buyer protection services.

Please note, however, that personal data may also be passed on by PayPal to service providers, subcontractors or other affiliated companies, insofar as this is necessary to fulfill the contractual obligations arising from your order or if the personal data is to be processed on their behalf.

Depending on the payment method selected via PayPal, e.g. invoice or bank debit, the personal data transmitted to PayPal are transmitted by PayPal to credit reference agencies. This transfer is used to verify your identity and credit rating in relation to the order you have placed. 8. Routine deletion and blocking of personal data

The data processed by us is deleted or limited in processing in accordance with Articles 17 and 18 of GDPR. Unless explicitly stated in this privacy policy, the data stored by us is deleted as soon as it is no longer required for the original purpose and the deletion does not conflict with any statutory storage requirements. Unless the data is deleted because it is required for other and legitimate purposes, its processing will be restricted. The data is therefore blocked and not processed for other purposes. This applies, for example, to data that must be kept for commercial or tax reasons.

As per legal regulations in Germany, storage takes place for 6 years in accordance with § 257 para. 1 HGB [“German Commercial Code”] (trading books, inventories, opening balance sheets, annual accounts, trade letters, accounting documents, etc.) as well as for 10 years in accordance with § 147 para. 1 AO (books, records, management reports, accounting documents, trade and business letters, documents relevant for taxation, etc.).

9. Standard legal basis

In accordance with Art. 13 of GDPR, it is our obligation to inform you about the standard legal basis of our data processing. If the legal basis is not stated in the Data Privacy Statement, the following applies: the legal basis for obtaining consent is Article 6 (1) lit. a and Art. 7 of GDPR, the legal basis for the processing for the performance of our services and the execution of contractual measures as well as the response to inquiries is Art. 6 (1) lit. b GDPR, the legal basis for processing to fulfill our legal obligations is Art. 6 (1) lit. c of GDPR, and the legal basis for processing in order to safeguard our legitimate interests is Article 6 (1) lit. f GDPR. In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 para. 1 lit. d of GDPR applies as legal basis.

If, in the course of our processing, we disclose data to other persons and companies (contract processors or third parties), transmit to them or otherwise grant them access to the data, this is done only on the basis of a legal permission (for example, if transmission of the data to third parties, such as to payment service providers, in accordance with Article 6 (1) (b) of GDPR is required to fulfill the contract), e.g. when you have consented to a legal obligation or based on our legitimate interests (for example, when using agents, web hosts, etc.). 

If we commission third parties to process data on the basis of a so-called "contract processing contract", this is done on the basis of Art. 28 of GDPR.

10. Right of objection

If your personal data is processed based on legitimate interests in accordance with Art. 6 para. 1 sentence 1 lit. f of GDPR, you have the right to file an objection against the processing of your personal data in accordance with Art. 21 of GDPR, as far as there are reasons for doing so, arising from your particular situation or the opposition directed against direct mail. In the latter case, you have a general right of objection, which is implemented by us without specifying any particular situation.

11. Rights of affected persons

You have the right:

  • in accordance with Art. 15 of GDPR, to request information about your personal data processed by us. In particular, you can request information on the processing purposes, the category of personal data, the categories of recipients, to whom your data has been or will be disclosed, the planned retention period, the right of rectification, cancellation, limitation of processing or opposition, the existence of a right of appeal, the origin of its data, if not collected from us, and the existence of automated decision-making, including profiling and, where appropriate, meaningful information about its details;
  • in accordance with Art. 16 of GDPR, to immediately demand the correction of incorrect or completed personal data stored by us;
  • in accordance with Art. 17 of GDPR, to demand the deletion of your personal data stored by us, except where the processing is for the exercise of the right to freedom of expression and information, for the fulfillment of a legal obligation, for reasons of public interest or for the assertion, exercise or defense of legal claims is required;
  • in accordance with Art. 18 of GDPR to demand the restriction of the processing of your personal data, as far as the accuracy of the data is disputed by you, the processing is unlawful, but you reject its deletion and we no longer require the data, however, you require it for the assertion, exercise or defense of legal claims or you have objected to the processing in accordance with Art. 21 of GDPR;
  • in accordance with Art. 20 of GDPR to receive your personal data that you have provided us in a structured, common and machine-readable format or to request the transfer to another person in charge;
  • in accordance with Art. 7 para. 3 of GDPR to revoke your previously granted consent from us at any time. As a result, we are not allowed in future to continue processing the data which was based on this consent and
  • according to Art. 77 of GDPR to complain to a supervisory authority.

12. Data security

We utilize the common SSL (Secure Socket Layer) method for site visits, in conjunction with the highest level of encryption supported by your browser. In general, this is 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can recognize that an individual page of our website is encrypted is by the closed key or padlock icon in the lower status bar of your browser.

We also take appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or total loss, destruction or against unauthorized access by third parties. Our security measures are continuously improved in line with technological developments.
